Hi All, I would be grateful if i could get some advise on the above subject. ScenarioI have given notice at current company and according to calculation my last day would be 26th June 2014 (4 weeks notice). New company have however proposed tentative start date of 26th June 2014 as well. What i have doneOn noting the "tentative" buzz word in the offer i went back to new company to see if this can be pushed forward. I was however told if i can't start 26th June it would have to be 24th July next as they have only certain dates for new starters orientation. Secondly i have spoken to my manager at current company to see if my last day can be brought forward a day (25th) so i can start at new one on the 26th. He has told me he will try but can't promise anything. My questionsWhile talking to HR contact at new company, she did suggest taking annual leave (if i had any left) to be able to start 26th June. I spoke to my manager about this and he thought it wasn't the best thing to do as it would mean me being employed by two companies on the 26th June which might mess up my taxes with HRMC as well as go against terms of my contract with both companies i.e. i can't work for any other company while in employment of either company. 1) If current company insist on last day as 26th June, should i just go ahead and take annual leave to start on 26th? 2) What really are the implications of (1) above? Anyone gone through or done similar? (P.S: I don't want to have to wait at home for a month doing nothing and more importantly not getting paid so 24th July really isnt much of an option for me)3) Any other advices or recommendations? Thanks in advance :)

Can u tell the new company that starting on a Thursday is a bit weird and could they instead let u join on the following Monday?Otherwise u may just have to wait a month. Not such a bad thig as we're currently having good weather.

@Bushy Eyebrow Partner: I have tried that but unfortunately as i have to go through the new starter's orientation its either the 26th June or 24th July as those are the only dates they have in the calendar for that presently.

In that case u need to lean on it current employer. Are thy really so bloody minded that they won't let u finish just 1 day earlier? If the answer is yes, then realistically u may just need to join a month later than planned. U could take the last day as holiday or something but I would be inclined to keep things "clean" and not do that because of likely contractual restrictions.

Depends on whether you want to burn bridges or not, you could;-1. throw a sickie - be in office day before and leave computer etc under desk - if they ask what was wrong tell them you had a schizo feeling come over you and you thought your other persona was at one role and you at another. Or catch a cold / food poisoning in last 2-3 days 2. Add up all the over hours you have worked recently and not been paid for - tell them you're taking this in Lieu or expect to be paid - make sure it adds up to more than 2 days - you can negotiate out of kindness you'll forfeit some of it but take the day off(actually know someone who did this - turned up said I resign these are the hours I've overworked in past period so by my calculation I can leave on the DATE and left DC

Just use your accumulated leave. I did the same thing and whilst it's true HMRC double taxed me, I revieced it all back after I filled in a P60.As for breach of contract, is he joking? Is your current employer really going to pursue you for breach of contract because you worked for another company on your last day...If anything it helps then because they won't need to pay you for any additional leave entitlement you did not use (or reduce your pay by one day).Seems your manager is just being difficult because he's annoyed your leaving. Explain to him that if he does not let you leave a day earlier then you will lose a whole months pay. If he says no then just pull a sickie.

Using accumulated/annual leave, etc. makes no difference. The only way is to politely ask to have the old job terminated a day earlier.

Thanks for all your responses. Very helpful and i'm grateful for that. I decided to speak to HR via my Manager to get them to let me go a day earlier and as at today the signals i'm getting from Line Manager is that they are happy for this to happen. Always good to walk through a door shutting it silently behind you as you never know; you just might have to walk through that door again :)Looking forward to starting new job in a few weeks! :)
